Main Responsibilities:

The Legal Affairs Office is in charge of comprehensive legal affairs under the Hangzhou Municipal Government.

1. Surveys, studies new situations, new problems arising from exercising state power  by law and building the government legal system. Proposes measures and processes to push ahead administration by law. Assists the city’s leaders in legal system affairs. Responsible for offering legal consultation to the municipal government. 

2. Plans, arranges the municipal government’s legislation work. Studies, drafts annual plans the municipal government’s legislation work. Implement the plans after getting approval.

3. Drafts or organizes drafting of important local regulations and government rules. Responsible for soliciting public opinion on the drafts with grassroots people being the close interested party. 

4. Responsible for reviewing, drafting on local regulation and government rule drafts submitted by other municipal government units. Coordinates solution of related issues arising from review of local regulation and government rule drafts.

5. Responsible for legislation assessment on government rules. Responsible for legislation explanation for government rules. Files municipal government rules with the State Council, the Provincial People’s Congress Standing Committee, the Provincial Government, and the Municipal People’s Congress Standing Committee. Responsible for dealing with feedback on legislative drafts compiled by the National People’s Congress Standing Committee, the State Council, the Provincial People’s Congress Standing Committee, the Provincial Government, and the Municipal People’s Congress Standing Committee.

6. Reviews legality of administrative and regulatory documents issued by the Municipal Government and the General Office of Hangzhou Municipal Government. Responsible for filing, reviewing administrative, regulatory documents and major administrative actions of district, county/county-level governments and units of the municipal government. Instructs on reviewing administrative and regulatory documents. 

7. Responsible for tackling litigations, arbitrations, executions and non-litigation affairs delegated by and on behalf of the municipal government. Providing legal advice on major decisions, administrative actions, contract actions and other legal affairs of the municipal government.  

8. Deals with cases of administrative reconsideration and administrative response to legal actions for the municipal government. Instructs on, supervises work related to administrative reconsideration and administrative response to legal actions. Responsible for counting numbers of such cases. 

9. Leads the municipal government units on organization, coordination of administrative intervention. Instructs on, supervises the city’s administrative intervention work. 

10. Responsible for reviewing, certifying the qualifications of organs of administration. Responsible for tackling complaints about law enforcement. Coordinates conflicts and disputes between government units arising from law enforcement. Responsible for supervising law enforcement of the municipal government. 

11. Organizes, pushes ahead work related to administration by law. Coordinates issues arising from law enforcement. Evaluates work related to administration by law (law enforcement responsibility system). Trains government workers on law enforcement, administrative reconsideration and administrative response to legal actions. Issues law enforcement certificates. 

12. Responsible for instructing on, coordinating to centralize administrative penalty power in urban administration. Researches, pushes ahead reform of administrative and law enforcement systems. 

13. Researches on common issues arising from implementation of laws, regulations and rules involving rules for government actions and administrative law enforcement. Such government actions include administrative legislation, administrative reconsideration, administrative response to legal actions, administrative mediation, administrative compensation, administrative penalty, administrative licensing, administrative fee collection, and administrative execution. Advises the municipal government on improving systems and solving problems. Drafts relevant supporting systems and measures. 

14. Organizes, reviews rules, regulatory documents issued by the municipal government. Edits, publishes compilation of local rules and regulations. Translates, submits the municipal government rules, policies and measures. Promoting knowledge of laws, regulations and rules among the public. Organizes theoretical research in building legal system and conducts relevant activities. 

15. Responsible for government information disclosure. 

16. Manages Hangzhou Arbitration Commission Office on behalf of the municipal government. 

17. Achieves other tasks delegated by the municipal government.
